Party Hotels.com - UK Leisure.net Ltd Booking Conditions

The following Booking Conditions together with the General Information contained on our website form the basis of your contract with UK Leisure.net Limited t/as Party Hotels, Henparties.com, Blackpool Hen Parties, Bournemouth Hen Parties, Blackpool Stag Parties, Stagparties.net, Brash Events. Please read them carefully as they set out our respective rights and obligations. By asking us to confirm your booking, we are entitled to assume that you have had the opportunity to read and have read these booking conditions and agree to them.

In these booking conditions, “you” and “your” means all persons named on the booking (including anyone who is added or substituted at a later date). “We”, “us” and “our” means UK Leisure Limited. “Arrangements” means the activities, events, accommodation, meals and other services of whatever description (or any of them), as applicable, booked through or arranged by us for you in accordance with our contract.

We sell the following types of arrangements:

(i) Package(s) – A Package means arrangements which constitute a “package” in accordance with the Package Travel, Package Holidays and Package Tours Regulations 1992 being a pre-arranged combination of at least two out of (i) transport, (ii) accommodation and (iii) other tourist services not ancillary to transport or accommodation and accounting for a significant proportion of the package, where the arrangements making up this combination are booked at the same time and at an inclusive price and which last at least 24 hours or include overnight accommodation.

(ii) “Accommodation only” – “Accommodation only” means arrangements consisting of overnight accommodation only*. For all accommodation only bookings we act as agent for the owner or other provider of the accommodation (referred to in these conditions as the “Owner”). Your contract for the accommodation will be with the Owner and not us. The Owner’s own terms and conditions will apply to that contract in addition to those set out below. The conditions set out below will apply except where otherwise expressly specified.

*NB In addition to your accommodation booking we may also assist you to book a table at a restaurant(s) or gain entry to a nightclub using the preferences you have provided us with. In such instances your booking will still be classed as an accommodation only booking. This will be the case regardless of any other wording used by us on our website, in any advertising material or elsewhere to describe this combination of arrangements.

(iii) “Activity only” – “Activity only” means arrangements consisting of a daytime or evening only*. For all activity only bookings we act as agent for the owner or other provider of the activity (referred to in these conditions as the “Owner”). Your contract for the accommodation will be with the Owner and not us. The Owner’s own terms and conditions will apply to that contract in addition to those set out below. The conditions set out below will apply except where otherwise expressly specified.

1. Making your booking

The first named person on the booking (“group leader”) must be authorised to make the booking on the basis of these booking conditions by all persons named on the booking and by their parent or guardian for all group members who are under 18 when the booking is made. By making the booking the group leader confirms that he/she is so authorised. The group leader is responsible for making all payments due to us. The group leader must be at least 18 when the booking is made. The payments referred to in clause 2 below must be made at the time of booking.

Subject to the availability of your chosen arrangements, we will confirm your booking by issuing a confirmation invoice. This invoice will be sent to the group leader. Please check this invoice carefully as soon as you receive it. Contact us immediately if any information which appears on the confirmation or any other document appears to be incorrect or incomplete as it may not be possible to make changes later. If you wish to, you may contact us by e-mail for any of the reasons mentioned in these Booking Conditions (for example, to request an amendment) providing you do so to [insert appropriate e-mail address]

2. Payment

a. Packages
A deposit of £25(usually) per person (or full payment if booking within 4 weeks of the date your arrangements are due to commence) must be paid to us at the time of booking. NB. Depending on the exact package you book, the deposit required may differ. You will be advised at the time of booking.

The balance of the cost of your arrangements must be received by us not less than 4 weeks prior to the date your arrangements are due to commence. This date will be shown on the confirmation invoice. If we do not receive all payments due in full and on time we will remind the Group leader that payment is overdue. If we do not then receive all payments due in full within 3 days of our issuing our reminder we will be entitled to assume that you wish to cancel your booking. In this case, we will be entitled to keep all deposits paid or due at that date. If we do not cancel straight away because you have promised to make payment, you must pay the cancellation charges shown in clause 7 depending on the date we reasonably treat your booking as cancelled.

b. Accommodation Only (Deposit Only before arrival)
A deposit per group member equal to the cost of their first night’s stay at the accommodation (or £10 per person if the group is booking for just 1 night) must be paid to us at the time of booking. The balance of the cost of your accommodation must be paid directly to the Owner/Hotel during your stay. Deposits are non-transferable.

c. Accommodation Only (Full Payment before arrival)
You will be advised at the time of booking if the hotel you are booking requires full payment in advance of stay. In such cases you will be required to pay an initial deposit of £50 plus the full payment normally within 14 days of your initial deposit payment. This period may be extended at Party Hotels discretion.

c. Activity Only (Full Payment at time of booking)
Activity Only bookings require full payment at the time of booking unless otherwise advised by UK Leisure.

e. Unless otherwise advised the cost of meals and drinks are not included in the price of your arrangements and must be paid for by you directly to the establishment /Owner concerned at the time.

f. Payments can be made to us using a valid credit or debit card, cheque or bank transfer. Any charges relating to payment to us using credit or debit cards will be advised at the time of booking. For ‘Accommodation Only’ bookings with balances payable on arrival, please check with the hotel prior to your arrival which methods of payment are acceptable and which (if any) charges apply.

g. We will not despatch any vouchers/tickets or associated documentation to you until balances (for Package bookings) or deposits (for Accommodation Only bookings) have been received by us in full.

h. Most hotels require either a refundable cash bond or credit card bond on arrival, as a guarantee against damages and relevant charges. Details of these can be found on the company website and/or booking confirmation. We advise you also to contact your hotel in advance of your stay to re-confirm any details of the bond required, so you can advise your group appropriately.

3. Your contract

A binding contract between us (or between you and the Owner for Accommodation or Activity Only bookings) comes into existence when we despatch your confirmation invoice to the group leader. We both agree that English Law (and no other) will apply to any contract you have with us and to any dispute, claim or other matter of any description which arises between us (except as set out below). We both also agree that any dispute, claim or other matter of any description (and whether or not involving any personal injury) which arises between us must be dealt with by the Courts of England and Wales only unless, in the case of Court proceedings, you live in Scotland or Northern Ireland. In this case, proceedings must either be brought in the Courts of your home country or those of England and Wales. If proceedings are brought in Scotland or Northern Ireland, you may choose to have your contract and any dispute, claim or other matter of any description which arises between us governed by the law of Scotland/Northern Ireland as applicable (but if you do not so choose, English law will apply).

4. The cost of your arrangements

Prices quoted to you at the time of your enquiry are correct to the best of our knowledge at that time. Please note however, changes and errors occasionally occur. You must check the price of your chosen arrangements at the time of booking. We reserve the right to increase / decrease and correct errors in advertised prices at any time before your arrangements are confirmed. We will advise you of any error of which we are aware and of the then applicable price at the time of booking (if not before). Please note that prices may be subject to limited availability, date restrictions or qualifying conditions. These will be notified to you before you book.

5. Special requests and medical conditions / disabilities

If you have any special requests you must advise us at the time of booking. Although we will endeavour to pass any reasonable requests on to the relevant supplier/Owner, we regret we cannot guarantee any request will be met. Failure to meet any special request will not be a breach of contract on our part. Confirmation that a special request has been noted or passed on to the supplier or the inclusion of the special request on your confirmation invoice or any other documentation is not confirmation that the request will be met. Unless and until specifically confirmed, all special requests are subject to availability. For your own protection, you should obtain confirmation in writing that a special request will be complied (where it is possible to give this) where it is important to you.

We regret we cannot accept any conditional bookings, i.e. any booking which is specified to be conditional on the fulfilment of a particular request. All such bookings will be treated as “standard” bookings subject to the above provisions on special requests.

If you or any member of your group has any medical condition or disability which may affect your holiday or has any special requirements as a result of any medical condition or disability (including any which affect the booking process), please tell us before you confirm your booking so that we can assist you in considering the suitability of the arrangements and/or making the booking. In any event, you must give us full details in writing at the time of booking and whenever any change in the condition or disability occurs. You must also promptly advise us if any medical condition or disability which may affect your arrangements develops after your booking has been confirmed. If we /any supplier/Owner (as applicable) reasonably feel unable to properly accommodate the particular needs of the person concerned, we must reserve the right to decline their reservation or, if full details are not given at the time of booking or the condition / disability develops after booking, cancel when we become aware of these details.

6. Changes by you

Should you wish to make any changes to your confirmed arrangements, you must notify us in writing as soon as possible. Whilst we will endeavour to assist, we cannot guarantee we will be able to meet any such requests. Where we can an administration fee of £5 per booking will be payable together with any costs incurred by ourselves and any costs or charges incurred or imposed by our suppliers/ the Owner (as applicable). A change of dates will normally be treated as a cancellation of the original booking and rebooking in which case cancellation charges will apply. Changes may result in the recalculation of the price of your arrangements where, for example, the basis on which the price of the original arrangements was calculated has changed. You will be required to pay any increase in price. NB If you make changes directly with the supplier of the arrangements concerned/the Owner as opposed to through us you may incur costs from both the supplier/Owner and us depending on the circumstances. In this event you must pay our costs in addition to those imposed by the supplier/the Owner and indemnify us against any costs imposed on us by the supplier/the Owner .

7. Cancellation by you

Should you or any member of your group need to cancel your arrangements once they have been confirmed, the group leader must immediately advise us in writing. Your notice of cancellation will only be effective when it is received in writing by us at our offices. As we/our suppliers and Owners incur costs from the time we confirm your booking, the following cancellation charges will be payable. Where the cancellation charge is shown as a percentage, this is calculated on the basis of the total cost payable by the person(s) cancelling excluding amendment charges. Amendment charges are not refundable in the event of cancellation.

Outside of the 28 days, a 50% refund is available within 14 days of the online purchase from UK Leisure.net Ltd. A refund can only be made to the purchaser and if payment was originally made by credit/debit card the refund will be made to the same card. A refund cannot be given once a booking has been made or on extended, expired or exchanged vouchers. Refunds are not given for mailing, fulfilment and express carriage charges or personalised items.
c. Depending on the reason for cancellation, you may be able to reclaim these cancellation charges (less any applicable excess) under the terms of an insurance policy you may have purchased. Claims must be made directly to the insurance company concerned.

d. Where any cancellation reduces the number of full paying group members below the number on which the price, number of free places and/or any concessions agreed for your booking were based, we will recalculate these items and re-invoice you accordingly.

8. Insurance

We consider adequate travel insurance to be essential. Travel insurance should cover (at least) the cost of cancellation by you or any member of your party. Please read your policy details carefully and take them with you on your break. It is your responsibility to ensure that the insurance cover you purchase is suitable and adequate for your particular needs.

9. Changes and cancellations by us/suppliers/Owners

a. Packages

We start planning the arrangements we offer many months in advance. Occasionally, we have to make changes to and correct errors in website and other details both before and after bookings have been confirmed and cancel confirmed bookings. Whilst we always endeavour to avoid changes and cancellations, we must reserve the right to do so.

Most changes are minor. Occasionally, we have to make a “significant change”. A significant change is a change made before departure which, taking account of the information you give us at the time of booking and which we can reasonably be expected to know as a tour operator, we can reasonably expect to have a major affect on your arrangements. The definition of a significant change will depend on the individual itinerary and circumstances.

If we have to make a significant change or cancel, we will tell you as soon as possible. If there is time to do so before the date your arrangements with us are due to commence, we will offer you the choice of the following options:-

(a) (for significant changes) accepting the changed arrangements or
(b) purchasing alternative arrangements from us, of a similar standard to that originally booked if available.
(c) cancelling or accepting the cancellation in which case you will receive a full and quick refund of all monies you have paid to us.

Compensation will not be payable and no liability beyond offering the above mentioned choices can be accepted where (1) we are forced to make a change or cancel as a result of unusual and unforeseeable circumstances beyond our control, the consequences of which we could not have avoided even with all due care or (2) we have to cancel because the minimum number of bookings necessary for us to operate your arrangements has not been reached (see above). No compensation will be payable and the above options will not be available if we cancel as a result of your failure to comply with any requirement of these booking conditions entitling us to cancel (such as paying on time) or where a change is a minor one.

Very rarely, we may be forced by "force majeure" (see clause 10) to change or terminate your arrangements after departure but before the scheduled end of your time away. This is extremely unlikely but if this situation does occur, we regret we will be unable to make any refunds (unless we obtain any refunds from our suppliers), pay you any compensation or meet any costs or expenses you incur as a result.

b. Accommodation / Activity Only

As we act as agent for the Owner we cannot accept any responsibility for any changes or cancellations made to your Accommodation Only booking. We will however pass on to you all details given to us of such changes or cancellations and any compensation or refunds provided by the Owner.

10. Force Majeure

Except where otherwise expressly stated in these booking conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our obligations under any contract we have with you is prevented or affected by or you otherwise suffer any damage, loss or expense of any nature as a result of "force majeure". In these booking conditions, "force majeure" means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include actual or threatened war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.

11. Our Liability to you
Accommodation Only Bookings: For all accommodation only bookings we act as agent for the Owner. Your contract for your accommodation is directly with the Owner. We accept no liability in relation to the accommodation itself or for the acts or omissions of the Owner. The terms and conditions of the Owner (if any) will apply to your contract. Our responsibilities are limited to making your booking in accordance with your instructions.
Activities: Every reasonable effort is made to ensure the client’s safety at all times, and that sites used adhere to Health and Safety Acts and have adequate insurance. Some activities contain an element of risk, these include but not exclusively shooting sports of all kinds, motor sports, water sports and air sports. UK Leisure.net Ltd shall accept no responsibility whatsoever for any injuries or loss incurred by the client or its guests, associates or agents during the event. By booking through UK Leisure.net Ltd you understand that on your (the clients) behalf UK Leisure.net Ltd will book activities that may contain an element of risk.
Please note, we cannot accept responsibility for any services which do not form part of our contract. This includes, for example, any additional services or facilities which your hotel or any other supplier agrees to provide for you where the services or facilities are not advertised by us and we have not agreed to arrange them as part of our contract and any excursion you purchase in resort. Please also see clause 16 “Excursions, activities and general area information”. In addition, regardless of any wording used by us on our website, in any advertising material or elsewhere, we only promise to use reasonable skill and care as set out above and we do not have any greater or different liability to you.

Please note, we cannot accept any liability for any damage, loss, expense or other sum(s) of any description (1) which on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you or (2) which did not result from any breach of contract or other fault by ourselves or our employees or, where we are responsible for them, our suppliers. Additionally we cannot accept liability for any business losses.

If you or any member of your party suffer death, bodily injury or illness we only accept responsibility where caused by the negligent acts and/or omissions of our employees whilst acting within the course of their employment.

Restaurants and Nightclubs: Please note that we do not inspect any of the restaurants/nightclubs that we assist you in booking/gaining entry to and we have no control over them. We cannot accept any liability if you or any member of your group are refused entry to any restaurant/nightclub. Please note that restaurants and nightclubs may withdraw offers and change terms at any time. The withdrawl of any special /free offers will not entitle you to cancel or change your arrangements without paying our normal charges. Please ask at the time of booking for further details.

Weather conditions: Please note that we cannot control the weather. Whilst some arrangements may require favourable weather in order for you to take part in those arrangements the provision of such weather does not form part of our contractual obligations to you. If you are unable to take part in your chosen arrangements due to adverse weather conditions you will not be entitled to change or cancel your arrangements without paying our normal charges. You will not be entitled to the options and/or compensation set out in clause 9.

12. Complaints and problems

In the unlikely event that you have any reason to complain or experience any problems with your arrangements during your break you must immediately inform the supplier of the service(s)/the Owner in question (as applicable). Any verbal notification must be put in writing and given to the supplier/the Owner as soon as possible. If any complaint or problem is not resolved to your satisfaction by the supplier/the Owner, you must contact us giving us full details and a contact number. Until we know about a complaint or problem, we cannot begin to assist you resolve it. Most problems can be dealt with quickly. If you remain dissatisfied, however, you must write to us within 14 days of the end of your arrangements giving your booking reference and full details of your complaint. Only the group leader should write to us. If you fail to follow this simple complaints procedure, your right to claim any compensation you may otherwise have been entitled to may be affected or even lost as a result.

13. Behaviour and damage

When you book with us, you accept responsibility for any damage or loss caused by you or any member of your group. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be made direct to the Owner or manager or other supplier as soon as possible. If the actual cost of the loss or damage exceeds the amount paid where estimated, you must pay the difference once known. If the actual cost is less than the amount paid, the difference will be refunded. You will also be responsible for meeting any claims subsequently made against us and all costs incurred by us (including our own and the other group’s full legal costs) as a result of your actions. You should ensure you have appropriate travel insurance to protect you if this situation arises.

We expect all clients to have consideration for other people. You must also abide by the rules of all suppliers (for example accommodation owners/managers). If in our reasonable opinion or in the reasonable opinion of any other person in authority (for example accommodation owners or managers), you or any member of your group behaves in such a way as to cause or be likely to cause danger, upset or distress to any third group or damage to property, we are entitled, without prior notice, to terminate the arrangements of the person(s) concerned. In this situation, the person(s) concerned will be required to leave the accommodation or other service. We will have no further responsibility toward such person(s) including any return travel arrangements. No refunds will be made and we will not pay any expenses or costs incurred as a result of the termination.

Many of the arrangements we offer (for example paintballing, go-karting, quad-biking or clay pigeon shooting) require a high level of concentration. The use of alcohol or drugs (or being under the influence of alcohol and drugs) during the use or enjoyment of such arrangements is strictly forbidden. If in our reasonable opinion or in the reasonable opinion of any other person in authority you or any member of your group are in breach of this clause then the provisions of the paragraph above will apply.

14. Conditions of suppliers.

Many of the services which make up your arrangements are provided by independent suppliers. Those suppliers provide these services in accordance with their own terms and conditions. Some of these terms and conditions may limit or exclude the supplier's liability to you. Copies of the relevant parts of these terms and conditions are available on request from ourselves or the supplier concerned.

16. Brochure / website / advertising material accuracy

The information contained on our website and in our other advertising material is believed correct to the best of our knowledge at the time of printing or publication. However, errors may occasionally occur and information may subsequently change. You must therefore ensure you check all details of your chosen arrangements (including the price) with us at the time of booking.
